The United States Patent Trademark Office (USPTO) are a United States federal agency in the US Department of Commerce. It is an organization that offers intellectual property services such as patents and trademarks. The USPTO is considered to be one of the most unique federal agencies because it operates on fees collected by users and not tax payer dollars.
The Patents Act of 1790 was the first federal statute of the United States. The USPTO was created with the Patent Act of 1790. Article 1, Section 8, Clause 3 of the United States Constitution provided: “Congress shall have the power…to promote the progress of science and useful arts by securing for limited times to authors and inventors the exclusive right to their respective writings and discoveries.”
Currently the USPTO is headquartered in Alexandria, Virginia. It has four regional offices. They are: San Jose, California; Denver, Colorado; Detroit, Michigan; Dallas, Texas.
The USPTO has certain procedures before it issues a patent or trademark. Upon making your application for a trademark with the USPTO (electronically or in paper form) the applications are reviewed. After review of the application, it is forwarded to the examining attorney. The examining attorney makes sure that the application complies with all rules and statutes. For a trademark application, there are certain federal requirements that must be met and the examining attorney verifies this. If all requirements are met and there are no objections to registration, the examining attorney can publish the trade mark.
The USPTO provides a wide range of services for clients to get their trademark or patent issued. For example, they have a trademark database which allows you to check if your trade mark has already been registered or applied for. The USPTO can also issue office actions. This is a letter by the examining attorney which lists problems with registering your trade mark. In addition, there is an opportunity to make corrections to your trade mark before actual publication. In certain circumstances, the USPTO may issue appeals of final refusal by the trade mark examining attorney. In conclusion, the USPTO is a unique federal agency. They work with due diligence to get each individuals US patent or US trademark issued.
