Is it possible to register other famous person’s names as trademark? The answer is “It is possible on condition”. In the cases like below, it is possible to register other famous person’s name.
1. If the famous person agrees to register the name as trademark.
If the famous person agrees/allows to register his/her name as trademark, then you can register that name as trademark.
2. If the famous person is the deceased.
If the famous person passes away, then anyone who occupies the mark first will be the owner of the mark
Then, will it be possible if someone wants to register his/her name which is identical to the name of another famous person as trademark? In this case, even though the name is his/her own name, consent of the famous person is essential to register the name as trademark. That means, if the famous person does not agree to register the name by a third party who has the same name, then the third party can’t register his/her own name as trademark. In this case, however, it is still possible to use the name as trademark without registration.
