Combined or Split Registration

Combined or Split Registration

Combined or Split Registration

The short answer: a combined filing puts the words and the device into one application. It costs least, but the mark must be used as a whole. A split filing registers the words and the device separately, so each part can be used and enforced on its own. If budget is tight and the brand always appears as one unit, file combined. If the parts are used separately, or you want the widest cover, file split or hybrid.

At a glance (Hong Kong)

  • Combined: one application, HK$2,500 for the first class, about 6 months to registration
  • Split: two applications (words plus device), about HK$5,000, filed and examined in parallel
  • Extra classes: HK$1,500 each, charged per application
  • Term: 10 years in Hong Kong, renewable for further 10-year periods
  • Biggest risk: a combined mark used only in part may be challenged when you enforce it

How to choose

A combined filing is simpler on paper and cheaper overall, but the mark must be used as a whole. If you later use only the words, or only the device, the scope of protection can be questioned. A split filing registers the parts separately: each can be used and enforced on its own, and if one is opposed or revoked the others survive.

  • Combined: limited budget, and the brand always appears as words plus device (for example on signage and packaging together).
  • Split words and device: the two are used apart — words on the website, the device on products.
  • Words only: the name itself is the main asset and will very likely be used alone in advertising, invoices and conversation.
  • Hybrid: budget and classes allow both the overall and the split protection, which is the widest cover.

Whichever you choose, search first: the word part must be checked against earlier similar marks, and the device against visually confusing ones. We search and advise on classes for free, and quote afterwards.

Cost and timing: combined versus split

Approach Applications Fee (HK$, first class) Timing Protection
Combined12,500about 6 monthswords and device as a whole only
Split2about 5,000about 6 months (filed together)words and device independent
Hybrid3about 7,500about 6 months (filed together)both overall and split

These are Hong Kong fees for the first class and exclude additional classes (HK$1,500 each); see the fee list for other markets. The split row assumes two applications (words plus device); registering both the Chinese and the English name adds more. Splitting costs more, but each part is protected on its own, and an opposition against one does not affect the rest. It can also be staged: file the most-used part first and add later.

Five questions to decide

  1. Will you use the mark in parts? If the website, invoices and spoken references use only the words, and products or signage only the device, split it.
  2. Is the name itself the main asset? If so, the word mark matters more than the device and should be filed first.
  3. Do you have both a Chinese and an English name? If both are used, register both; registering one leaves the other unprotected.
  4. Can the budget be staged? Then file the core word mark first and add the device and extra classes as the business grows.
  5. Will you trade in several classes? The more classes, the more the per-application extra fees matter — do not pay for classes you do not trade in.

Four common mistakes

  • Registering the logo but not the words: a competitor can use a similar name in a different typeface, and you have little to rely on.
  • Registering the Chinese name but not the English: both are marks you actually use, so both need their own registration.
  • Classes drawn too narrowly: covering only today's products means refiling when you expand, by which time someone else may hold the class.
  • Assuming registration covers every product: protection is limited to the goods and services listed.

How we handle it

  1. Free search: check whether the words and the device are close to earlier marks, and identify registrations that may block you.
  2. Class advice: list the classes that match what you sell now plus short-term expansion.
  3. Decide combined or split: a firm quote for one, two or three applications based on how you use the brand and your budget.
  4. Filing: prepare the representation and the specification, file, and follow the official correspondence.
  5. Examination to registration: handle formality, substantive examination and opposition risk; monitoring can be added after registration.

Frequently asked questions

Q1: After a combined registration, can I use only the words?
A combined mark is judged on its overall impression. If only part is used over time, enforcement may be challenged because the mark in use differs from the mark registered, so splitting is safer when the parts may be used apart.

Q2: Is splitting much more expensive?
It means one more application, so the cost rises, but each part is protected on its own. You can file the most-used part first and add later; the quote shows both options.

Q3: Which class should I register first?
Start from what you actually sell or provide, then add short-term expansion. Too many classes raise cost; too few leave gaps — which is what the free class advice is for.

Q4: Are the two split applications granted together?
They are examined independently. Filed at the same time they usually move in parallel, and a citation or opposition against one does not affect the other — the main advantage of splitting.

Q5: Can I change the typeface or colours after registration?
Registration protects the representation filed. A significantly different typeface or colour scheme changes the overall impression and may need a new application; minor adjustments are usually acceptable, but the line depends on the facts.
